1.3 The information and services available on the Site are provided for the sole purpose of individuals looking for employment opportunities and career information.
2.1 This Site contains information, text, data, graphics, photographs, illustrations, artwork, names, logos, trade marks and information about Focus Management Consultants Ltd and its partners and on the products and services it and they provide (the “Information”).
2.2 The Site, Information and Content (as described below) is provided “as is” and on an “as available” basis only and Focus Management Consultants Ltd does not give any representation, warranty, condition or other term as to its accuracy, timeliness, completeness, performance or fitness for a particular purpose of the Site or any of the Content or Information. We have tried to ensure that all the Information provided on the Site is correct at the time of publication. However no responsibility is accepted by or on behalf of Focus Management Consultants Ltd for any errors, omissions, or inaccurate Information or Content on the Site. We do not attempt to exclude any rights you may otherwise have as a consumer that We cannot exclude as a matter of law.
2.4 Without prejudice, save in respect of death or personal injury resulting from our negligence or fraud, neither Focus Management Consultants Ltd nor any of its directors, employees or other representatives will be liable for any loss you suffer including, without limitation, indirect or consequential loss, or any damages arising from loss of use, data or profits, whether in contract, tort or otherwise, arising out of or in connection with the use of this Site.
2.5 You accept that after you leave this Site (whether knowingly or not) Focus Management Consultants Ltd can no longer be responsible in any way for any material that you encounter and We exclude to the fullest extent permitted by law all liability that may arise with respect to or as a result of such material causing any damage, costs, injury or financial loss of any kind.

3.2 You are solely responsible for all use of and for protecting the confidentiality of your email verification and password. You must not share this information with any third parties. You must notify Us immediately of any unauthorised use of them or any other breach of security regarding Our Site that comes to your attention. Additionally, you indemnify Us against any unauthorised use of your User details, including use by a third party where you have allowed or facilitated access.
3.3 You undertake to register as a User using accurate, complete and current information and to maintain and update any changes to that information.
3.4 You acknowledge that permission to become a User is granted at the sole discretion of Focus Management Consultants Ltd and such permission may be withdrawn at any time without notice.
3.5 You can use certain Services without registration. To provide you with the specific Services under registration, we will store the date of your last activity on the Site (“Last Activity Date”), which can include the date of your registration, and last use of Services like applying for a job.
3.6. Your Account
3.6.1 Certain Services will only be available as part of an account on the Site. If you enter into an Agreement for an account, you can use the additional Services as described hereinafter. You can register for an account as described below.
3.6.2 Should you wish to create an account with us, you must provide a valid email address and a password which we will store to perform our obligation under this Agreement. After we have received your registration application to create an account, we will confirm the receipt of such application with a message to the email address provided by you. The Agreement for your account between you and us will come into effect when your account is activated.
3.6.3 The completion of the registration by you only constitutes an offer to enter into a contract. We reserve the right to accept or decline the conclusion of the contract in its own discretion. There is no right to claim a conclusion of contract.
3.6.4 You must provide the requested information and data completely and truthfully. You are responsible to keep your contact data (especially your email address) up to date and to secure that you can be contacted under the address provided and that the email address is not transferred to another person. Should any of the provided data change, you must adjust and correct the data immediately. In the event of incomplete or false information provided by you, we shall have the right, to block your account and the access to our Site temporarily or permanently and/or terminate in accordance with clause 3.13.
3.7. Your Profile
3.7.1 You can create a profile (“Profile”) within your account, which will consist of various CV related pieces of information, your job preferences as well as attachments provided by you. It will also keep a record of your activity on our Site.
3.7.2 You can use your Profile to apply to job advertisements that are published on the Site. We will also use the data you have provided as part of your Profile to provide you with job ad recommendations tailored to your needs based on your Profile data. To provide you with the specific Services under the Profile, we will store the date of your last activity on our Site (“Last Active” date), which will be the date you most recently updated your profile or CV or the date you last applied for jobs using the Services.
3.7.3 If you choose to create a Profile with us, then we will keep your CV on file until you ask us to delete your account from our Site.
3.7.4 We do not warrant or guarantee a minimum volume of storage capacity for your Profile. We reserve the right to temporarily or permanently restrict the data volume for uploads of data, especially if necessary due to technical reasons, for example in order to maintain or optimise the Service.
3.8 Login to your Profile
3.8.1 Please ensure that the Services under your account are only used by you. You shall keep access data and passwords in strict confidence. You are responsible for any and all use of access data and passwords and all actions, which occur in context with the use of your account. If any unauthorised third party had actual or hypothetical access to your login details (email address in combination with the password), you shall immediately inform Us and change any relevant password as soon as possible.
3.9 Application History
Within your account we store your applications to job listings that were published on the Site in a history that can be accessed via your account. Information from such applications can be used to prefill fields if you create a Profile in accordance with clause 3.7.
3.10 Job alerts
You can create job alerts through your account on our Site. That means you will then regularly receive job alerts about listings which match your criteria. You can create job alerts manually which match a profile that has been defined by you in advance.
3.11 Dormant Emails
If you have an account but you have been inactive for a predetermined period, we may email you to check whether you are still looking for work. This will not occur if you have unsubscribed to receive emails from us.
3.12 Deceased User
3.12.1 In the event of the death of user, a person authorised to act on behalf of the estate, or a verified immediate family member of the deceased can request to have the deceased user’s account removed. We will require additional documentation for this request in order to avoid unauthorised and false reports. Be assured that the requested information will remain confidential and will be deleted once we have reviewed it.
3.13 Term and Termination
3.13.1 The Agreement with you regarding your user account and the services provided under these terms is for a fixed term unless you voluntarily request us to delete your account. Either party may terminate this Agreement with immediate effect and without cause.
4.1 Websites or web pages to which this Site is linked are for information purposes and have not been reviewed by Focus Management Consultants Ltd. To the extent that such websites or web pages do not contain information about Focus Management Consultants Ltd, our services, we accept no responsibility for the content of such Sites or web pages, nor do we accept responsibility for any losses or penalties incurred as a result of your use of any links or reliance on the content of any website to which this Site is linked.
4.2 When you access a website, through a link from the Site, you accept that it is independent from the Site and that Focus Management Consultants Ltd has no control over the content of the linked third party website. Accordingly a link to a website does not mean that Focus Management Consultants Ltd endorses or accepts any duty or responsibility for the content, accuracy or the use of the contents of such website. The content on third party websites may change without notice to Focus Management Consultants Ltd. You should take precautions to insure protection of your privacy as well as to insure against Destructive Features (as described below).

We adhere to the Employment Agencies Act 1973 and/or the Conduct of Employment Agencies and Employment Business Regulations 2003. As a candidate you will not be charged for using any of the services offered on our Site.
The job application service allows you to apply for relevant jobs with Us and our owned and operated Site. CV registration allows Us to consider your details against specific current vacancies or future opportunities.
By registering your CV you agree to Us sharing your CV internally and with your consent presenting your details to relevant and appropriate clients. This means that you give us non-exclusive, worldwide licence of any rights all of which are royalty-free. This includes any intellectual property rights, found in the CV or any additional information you provide to Us, to share as is reasonably accepted to fulfil the services we provide as a food recruitment specialist business.

Focus Management Consultants Ltd reserves the right, at its discretion, to make changes to any part of this Site, the Information or these Terms. Should these Terms be amended, we will publish details of the amendments on the Site. It is your responsibility to refer to and comply with these Terms on accessing this Site. Failure to comply may lead to action being taken against you. By continuing to use the Site after we have published the notification you agree to be bound by these Terms as amended.
11.1 If these Terms or any part of them should be determined to be illegal, invalid or otherwise unenforceable under the laws of any state or country in which these Terms are intended to be effective, then to the extent that they are so illegal, invalid or unenforceable, they shall in that state or country be treated as severed and deleted from these Terms and the remaining terms shall survive and remain in full force and effect and continue to be binding and enforceable in that state or country.
11.2 If you breach these Terms and We take no action against you, We will still be entitled to enforce Our rights against you in relation to that breach and to use Our rights and remedies in any other situation where you breach these Terms.
Focus Management Consultants Ltd will not be responsible for any breach of these Terms caused by circumstances beyond its reasonable control, including without limitation acts of god, war, terrorism or technical difficulties.
Certain files of Information may be available for download from the Site. These files of Information are subject to these Terms.
Except for our affiliates, directors, employees or representatives, a person who is not a party to these Terms has no statutory or other right to enforce them, to the extent that any such right can be lawfully excluded.
